TERMS & CONDITIONS OF RENTAL

2. DELIVERY & RETURN CHARGES

Melaka Airport: Free delivery

Melaka Town Area: RM20 per way

3. SECURITY DEPOSIT
A refundable security deposit of RM150 is required for local cars (Perodua / Proton).

The deposit will be refunded within 3–5 working days after the vehicle is safely returned.

This deposit is to cover potential summons or fines such as speeding, AES violations, parking offences, or other traffic-related penalties incurred during the rental period.

For luxury or imported vehicles, the deposit amount varies depending on the vehicle model.

Refunds will be made via online bank transfer.
4. TRAFFIC-RELATED OFFENCES
The Authorized Driver is fully responsible for all summons, fines, and penalties issued by:

Malaysian Traffic Police
-
Road Transport Department (JPJ)
-
Local Municipal Authorities
This includes parking charges and offences caused by the Authorized Driver or any related third party during the rental period.
5. DRIVER REQUIREMENTS
-
Authorized Driver must be 21–60 years old.
-
Must possess a valid Malaysian driving licence or valid International Driving Permit.
-
Minimum one (1) year driving experience required.

Malaysian ‘P’ Licence holders must provide and display their own ‘P’ licence sticker on the vehicle during the rental period.
6. EXTENSION OF RENTAL PERIOD
Rental extensions must be requested before the rental expiry time:

Monthly rental: Up to 7 days

Weekly rental: Up to 3 days

Daily rental: Up to 1 day
-
Hourly rental: Up to 30 minutes
All extensions are subject to vehicle availability and owner approval.
Failure to request an extension may result in the owner lodging a police report for a missing vehicle.
7. ACCIDENT & DAMAGE RESPONSIBILITY

In the event of an accident, the Authorized Driver must inform the agent or owner immediately, especially if a police report is made.

The Authorized Driver is responsible for all damages caused by negligence, carelessness, natural disasters, or third-party involvement during the rental period.

Repair costs must be borne by the Authorized Driver unless the damage is due to a fatal accident.
Damage Repair Charges

A RM50 per day surcharge will be charged for the duration the vehicle remains in the workshop.

Repairs must be carried out at the owner’s panel workshop, unless otherwise agreed.
Collision Damage Waiver (CDW)

CDW: RM10 per day
-
Accident excess varies by vehicle class.

With CDW: RM800 excess

Without CDW: RM1,500 excess

8. PROHIBITED USE
The vehicle must not be used for:

Illegal or criminal activities under Malaysian law
-
Transporting the vehicle outside Malaysia
-
Commercial use, sub-leasing, or use by unauthorized drivers
Only the Authorized Driver is permitted to operate the vehicle.
9. PERSONAL BELONGINGS
Top Marque Car Rental is not liable for any loss or theft of personal belongings left inside the vehicle during or after the rental period.
10. CLEANLINESS & HYGIENE
Strictly no foul-smelling items allowed, including but not limited to:

Durian

Vomit
-
Food or beverage spills
Cleaning charges of RM100 or more will apply depending on the severity.
11. ACKNOWLEDGEMENT
The Authorized Driver confirms that they have read, understood, and agreed to all Terms & Conditions stated in the Top Marque Car Rental Agreement before using the vehicle.
